Terms of Service

Plain-language summary, not a substitute for the terms below: You buy a MailTwin license through LemonSqueezy. The license lets you run MailTwin on a fixed number of Macs. The app is provided as-is with no warranty. You're responsible for the AI provider you choose and what they do with your data. Disputes are governed by Norwegian law. See the refund policy for the 30-day money-back guarantee.

1. Parties and acceptance

These Terms of Service ("Terms") form an agreement between Smilodon AS, a company registered in Norway ("Smilodon AS", "we", "us") and the natural person or organisation that purchases or uses MailTwin ("you"). By installing or using MailTwin you agree to these Terms.

2. License grant

Subject to your compliance with these Terms and payment of the applicable fee, Smilodon AS grants you a non-exclusive, non-transferable, non-sublicensable license to install and run Mail AI on the number of Macs corresponding to the seats your purchase includes (1 for a single license, 5 for a 5-pack). The license is perpetual for the version you purchased; one year of updates from the purchase date is included.

A 14-day free trial is available without payment. After 14 days, MailTwin continues to launch but limits AI actions to one request per day until a license is activated.

3. Bring your own AI provider

MailTwin does not include AI inference. To use AI actions you must provide your own credentials for one of the supported providers (Apple Intelligence, Anthropic, OpenAI, xAI, Google, Groq, DeepSeek, or a local Ollama server). Each provider has its own terms of service, privacy policy, and pricing — you accept those directly with that provider, and Smilodon AS is not a party to that relationship. MailTwin passes your prompts to the provider you choose; what the provider does with that data is governed by the provider's terms.

MailTwin ships updates via Sparkle. We may add, change, or remove features in updates. We will not remove features that materially reduce the value of your license without offering a refund pro-rated against the unused portion of the included update window.

The handling of your data is described in the Privacy Policy, which forms part of these Terms.

7. Payment and billing

Purchases are processed by LemonSqueezy as the merchant of record. LemonSqueezy collects sales tax / VAT / GST as required by your jurisdiction. Their terms apply to the payment transaction; ours apply to the use of MailTwin.

9. Termination

You may stop using MailTwin at any time and uninstall it. We may suspend or terminate your license if you breach these Terms in a way that you do not cure within 30 days of receiving notice from us. On termination, you must uninstall MailTwin; sections 10-13 of these Terms survive termination.

10. Disclaimer of warranty

MailTwin is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that MailTwin will be error-free or uninterrupted. AI providers occasionally change APIs, Apple occasionally changes AppleScript and the MailKit extension APIs in macOS updates, and MailTwin may temporarily not work as expected as a result. We aim to ship fixes promptly via Sparkle updates.

11. Limitation of liability

To the maximum extent permitted by law, Smilodon AS's aggregate liability arising out of or related to MailTwin is limited to the amount you paid for your license in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under mandatory applicable law (including, in the EU, liability for death, personal injury, fraud, or gross negligence).

12. Governing law and disputes

These Terms are governed by the laws of Norway. Disputes that cannot be resolved through good-faith negotiation will be subject to the exclusive jurisdiction of the courts of Oslo, Norway, save that consumers retain the right to bring proceedings in the courts of their country of residence as required by mandatory consumer protection law.

13. Changes to these Terms

We may update these Terms. Material changes will be announced in MailTwin release notes and reflected in the "Last updated" date at the top. Continued use of MailTwin after a change constitutes acceptance.
